Booking Terms

All bookings are made with Dipaways LLC (us/we), a registered travel and tourism company based in San Diego, California, USA. By completing a booking, you are deemed to have agreed to these terms and conditions and your booking will be accepted on this basis. We will issue a booking confirmation via email once your booking has been accepted.

Participation Requirements:
All participants on our group getaways must be over the age of 21. There are no age limits on our private getaways. Contact us if you have questions or requests regarding requirements for a trip.

Your Personal Details:
We collect some personal details when you book an experience. Necessary details vary by trip; they include but are not limited to full name, address, date of birth, phone number, email, nationality, proof of travel insurance, copy of passport, flight confirmations, and any medical conditions that may affect your ability to complete your trip.

Inclusions & Exclusions:
Accommodations, ground transportation, activities, meals, a trip host, and a professional photographer are included as described in getaways details you receive closer to your departure. "All-inclusive" is defined as the inclusions for your specific trip. The price of your trip does not include flights, unless specified. Passport or visa fees, immunization costs, travel insurance, optional activities, or any other personal expenses are not included.

Passport & Visas:
Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct entry requirements for your trip; please refer to the getaway details for more information. We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation.

Trip Changes:
While we aim to operate all experiences as described, the itinerary provided for each trip is representative of the types of activities planned. It is understood that the route, schedules, itineraries, amenities, and mode of transport may be subject to change without prior notice due to local circumstances or events. If we make a major change, we will inform you as soon as reasonably possible.

Authority on Trips:
Our group getaways are hosted by a designated team member or local partner referred to as the Trip Host. The decision of the Trip Host is final on all matters likely to affect the safety or well-being of any participant or team member participating in the trip. If you fail to comply with a decision made by a Trip Host or interfere with the well-being or mobility of your trip participants, the Host may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.

Acceptance of Risks:
You acknowledge that all travel involves a degree of personal risk and the nature of your trip is adventurous. You will be visiting places where the political, cultural, and geographical attributes may present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

Limitation of Liability:
Dipaways contracts a network of third-party companies, agencies, and individuals to assist in the operations of our experiences. We are not responsible for the acts and omissions of these third parties. To the fullest extent permitted by law: You release Dipaways and our employees, contractors, and representatives from any and all liability for damages, loss, injury, or death which you may suffer (directly or indirectly) in connection with or as a result of your participation in a trip. You expressly waive any claims you may have against us arising out of or in connection with your participation in a trip. Any condition or warranty which would otherwise be implied by law into these Terms (Implied Warranty), is excluded.

Optional Activities:
Optional activities not included in the trip price do not form part of the trip or this agreement. You accept that any assistance given by your Trip Host or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

Booking Changes:
At our full discretion, we may permit changes to your booking up until 90 days before your trip. For example, you may request to switch from one trip to another departing within 12 months, or transfer your booking to a different person. Transfers to another person are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another destination can only be made to a departure within the next two cycles of trips. No changes are permitted to your booking within 90 days of departure.

Your Privacy:
Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our services. The information may be disclosed to our partners, service providers, or other suppliers to enable us to operate the trip. We will otherwise protect your details in accordance with our full Privacy Policy.

Photos, Videos, and Marketing:
By booking and/or joining a trip, you consent to the use of any images or videos taken for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images and videos for publicity and promotional purposes.

Travel Health Insurance:
Travel insurance is strongly suggested for all our participants and should be taken out at the time of booking. Your insurance should cover your health while traveling and any unexpected travel disruptions. We also strongly recommend that it covers cancellation, curtailment, personal liability, loss of luggage, and personal effects. We collect any travel insurance details prior to your trip; In some cases, you will not be able to join the trip without these documents.

Cancellations By You:
A full refund or trip credit will be issued for cancellations within 7 days of booking. After then, you can receive a full trip credit towards your next trip. A cancellation will only be effective when we receive a written confirmation via email or a request on dipaways.com. Cancellations after 60 days of booking will receive a credit less any unrecoverable expenses by us or our third-party partners. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund or credit will be provided. You are strongly advised to take out cancellation insurance to cover your booking.

Cancellation By Us:
While unlikely, we may cancel a trip at any time prior to departure, due to natural disasters, terrorism, political instability, or other external events that make it no longer viable to operate the planned itinerary. If your trip is canceled, we will notify you immediately and provide instructions for the next steps. In circumstances where the cancellation is due to external events outside our reasonable control, we may issue a trip credit or refund less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance, or non-refundable flights. Please note that additional cancellation terms may apply to some trips; we will advise if differences apply. You are strongly advised to take out cancellation insurance to cover your booking.

Severability:
In the event that any term or condition is unenforceable, void by operation of law, or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly. All remaining terms and conditions continue as binding.

Applicable Law:
The laws of California govern these terms and conditions to the fullest extent allowable. Any disputes in connection with these terms and conditions must be initiated in the courts of San Diego, California.
